Intro

                              THE UTTAR PRADESH HOMOEOPATHIC MEDICINE (AMENDMENT) ACT, 1977
                                             [U. P. Aar No. 14 OF 1977]
                                   (As passed by the Uttar Pradesh Legislature)
                                                      AN
                                                      ACT

further to amend the Uttar Pradesh Homoeopathic Medicine Act, 1951 and to make consequential amendments in the U. P. State Universities Act, 1975. IT is HEREBY enacted in the Twenty-eighth Year of the republic of India as follows :-

                                                    CHAPTER I
                                                   Preliminary

1.(1) This Act may be called the Uttar Pradesh Homoeopathic Medicine (Amendment) Act, 1977.
  (2) It shall be deemed w have come into force on August 8, 1977.
                                                    CHAPTER II
                           Amendment of the Uttar Pradesh Homoeopathic Medicine Ad, 1951
2. In section 2 of the Uttar Pradesh Homoeopathic Medicine Act, 1952, hereinafter in this Chapter referred to as the principal Act, clause (bb) shall be omitted.
3. In section 41 of the principal Act, for clauses (1) and (2), the followtng clauses shall be substituted, namely:—

" (1) to recognise homoeopathic educational or instructional institutions for purposes of affiliation and to suspend or withdraw such recognition;

 (2) to prescribe courses of study and curricullam for general instruction or special or refresher courses ire-institutions affiliated to the Board in such branches of the Medical Science of Homoeopathy as the Board may think fit;
 (3) to hold examinations, and to grant diplomas to persons who shall have successfully pursued a course of study in the institutions affiliated to the Board;

(3-A) to exercise general supervision over the residence and disciplinary arrangements made by the educational institutions affiliated to the Board and to make arrangements for promoting the health and general welfare of their students;"

4. Section 41-A, 41-B and 41-C of the principal act shall be omitted.
5. For section 53 of the principal Act, the following section shall be substituted, namely :—
   "53. (1) With effect from the date of commencement of the Uttar Pradesh Homoeopathic Medicine (Amendment) Act, 1977, regarding all members of the Board including the Chairman and the Vice-Chairman shall vacate their offices as such for a period of two years from the said date such person

as the State Government may, from time to time, appoint in that behalf as controller, shall exercise and perform, so far as may be, the powers and duties of the Board and shall be deemed to be the Board for all purposes:

Provided that the State Government may by notification extend the said period by one year.
       (2) The State Government may appoint an Examination Committee, to aid the Controller in the matters of holding examinations and appointing examiners and performing such other functions as be notified.
6. After section 53-A of the principal Act, the following section shall be Insertion of new

inserted, namely :— section 5341

   "53-B. (1) The State Government may, by notification, authorise any following Universities, namely the University of

of Agra and the Kanpur University, to hold examination for, and grant diplomas in, Homoeopathy.

          (2) The State Government may, by notification authorise such University to take over the function of holding of examinations for 
              courses prescribed by the Board with effect from such date as may be specified in the notification, and thereupon the powers and 
              functions of the Board in that behalf shall cease.
          (3) The State Government may, for giving effect to the notifications referred to in sub-section (1) or sub-section (2), by notified 
              order make such adaptations in this Act as it may think fit."

7. In section 55 of the principal Act, in sub-section (I), the second proviso Amendment of shall be omitted.
8. In section 56 of the principal Act, in sub-section (2), clause (qq) second proviso shall be omitted. 
                                                        Chapter III
                                     Amendment of the U.P. State Universities Act, 1973
9. In section 5 of the Uttar Pradesh State Universities Act, 1973, herein after in this Chapter referred to as the principal Act, after sub section (4), following sub-section shall be inserted, namely :—
  " (5) Notwithstanding anything contained in sub-section (I) the homoeopathic educational or instructional institutions throughout Uttar Pradesh may be affiliated to the University of Agra or the Kanpur University."
10. After section 7 of the principal act, the following section shall be inserted, namely:-
   "7-A. Upon being authorised by the State Government by notification Additional power under the Uttar Pradesh Hornoeopathie Medicine Act,

and duties of cer-1951, the University of Agra or the Kanpur Universities, as the case may be, shall—

    (a) hold examinations for and grant diplomas in, Homoeopathy, 
    (b) take over the functions of holding of examinations for courses prescribed by the Board of Homoeopathic Medicine constituted under the said Act and granting diplomas, and exercise and perform all the powers and functions of such Board under the said Act with respect to holding of such examinations and granting of diplomas."
                                                         CHAPTER IV
                                                    Transitory provisions
11. With effect from the date of commencement of this Act the monies credited to the Faculty Fund established under sub-section (5) of section 41-A of the Uttar Pradesh Homoeopathic Medicine Act, 1951, as it stood before its repeal by section 4, shall stand transferred to the Homoeopathic Fund established under section 44 of the said Act.
                                                          CHAPTER V
                                                        Miscellaneous

12. (1) The Uttar Pradesh Homoeopathic Medicine (Amendment) Ordinance, 1977 is hereby repealed.
    (2) Notwithstanding such repeal, anything done or any action taken under the principal Acts as amended by the said Ordinance shall be deemed to have been done or taken under the corresponding provisions of the principal Acts as amended by this Act, as if this Act were in force at all material times.
