Andhra Pradesh (Agricultural Produce And Livestock) Markets (Amendment And Validation) Act, 1971 1 of 1971 [02 January 1971] An act to amend the Andhra Pradesh (Agricultural Produce and Livestock) Markets Act, 1966 Be it enacted by the Legislature of the State of Andhra Pradesh in the Twenty-first Year of the Republic of India as follows: 1. Short Title And Commencement : (1) This Act may be called the Andhra Pradesh (Agricultural Produce and Livestock) Markets (Amendment and Validation) Act, 1971. (2) It shall be deemed to have come into force on the 11th October, 1970. 2. Validation Of Certain Notifications, Etc : Notwithstanding any judgment, decree or order of any court, tribunal or other authority, the notification of the Government in the Food and Agriculture Department in G.O.Ms. No. 2095, dated the 29th October, 1968, published at pages 1035 to 1039 of Part II of the Andhra Pradesh Gazette, dated the 7th November, 1968, issued or purporting to have been issued under sub-section (3) of Section 3 of the principal Act, shall be deemed to have been issued under Section 3 of the principal Act as amended by this Act; and accordingly, the notification so issued and the declaration of any new notified area by separation of area from any notified area or by uniting two or more notified areas or parts thereof, or by uniting any area to a part of any notified area the abolition of any market committee, the constitution or reconstitution of any market committee, any election held, any proceeding conducted, any order passed or any other action taken under the provisions of the Principal Act, as a sequel to, or in pursuance of, such notification, shall not be deemed to be invalid or ever to have become invalid on the ground that there is no provision or power in the principal Act to issue the said notification and as a sequel to, or in pursuance of, the said notification to declare any new notified area as aforesaid, to abolish any market committee, to constitute or reconstitute any market committee, to hold any election, to conduct any proceeding, to pass any order or to take any other action; and if any election, nomination or appointment of a member held or made to a market committee, whether constituted or reconstituted under the provisions of the principal Act, is invalid on any other ground, such election or nomination or appointment shall not be deemed to have become valid by virtue of this section; but no act or proceeding of any such market committee shall be deemed to be invalid or ever to have become invalid, by reason only of the existence of any vacancy among its members or any defect in the constitution or reconstitution thereof. 10. Repeal Of Ordinance 4 Of 1970 : The Andhra Pradesh (Agricultural Produce and Livestock) Markets (Amendment and Validation) Ordinance, 1970, is hereby repealed.]]
